Court Orders Reinstatement of Edo Local Government Chairmen, Strengthening Democracy
A High Court in Benin, Edo State, on Friday ruled in favor of the reinstatement of the suspended chairmen and vice-chairmen of the state's 18 local government councils. The court, led by Justice Efe Ikponmwonba, granted the order in response to a lawsuit (No: B/307/OS/24) filed by the affected council leaders.
The court also issued an injunction, preventing the defendants, including Governor Monday Okpebholo and the Edo State Government, from acting on the resolution passed by the State House of Assembly that had suspended the council leaders. Additionally, the court ruled that the status quo as of December 12, 2024, should remain unchanged until the motion on notice, filed on that date, is heard and determined.
The judge adjourned the case until February 17, 2025, for further proceedings and ordered that a hearing notice be issued and served to the defendants.
Reacting to the ruling, the Vice Chairman of the Association of Local Governments of Nigeria (ALGON) in Edo State, Tajudeen Alade, expressed that the court's decision, along with comments from Fagbemi, would help strengthen Nigeria's democracy.
He stated, "ALGON Edo State, along with the national body, has issued statements in support, but most importantly, the statement from the Attorney General of the Federation shows we are prepared for the journey ahead to rescue Nigeria from its challenges."
Alade emphasized the commitment of the local government chairmen to continue their efforts in delivering democratic benefits to the people of Edo State, despite economic challenges. "We are determined to overcome the current economic difficulties through unity and hard work," he added.
The council chairmen also reiterated their willingness to work with Governor Okpebholo for the progress of the state. Alade remarked, "The governor remains our father, and we will continue to respect him. Allegations of misconduct or insubordination do not apply here because we understand the importance of collaboration between the local government and the state to ensure progress."
He assured that, despite the conflict, there would be no confrontation between the local governments and the state. "We remain committed to working together with the governor and the House of Assembly. I believe they will reconsider their stance, and the court's ruling is not just in our favor but aims to strengthen democracy."
